Is 26 months too long to be paid on a claim after an accident? After waiting 26 months to receive settlement from the insurance company, an insurance bad faith case filed by the Mastrangelo Law Offices on behalf of the injured person. The accident in this case involved an injured iron worker who was driving a truck that was rear ended. We know accidents happen, but when you get hurt the bills start now.

The plaintiff in the case was an iron worker who sustained injuries when the truck she was driving was rearended.  After settling her claim with the responsible person’s insurance company for the $25,000 policy limit, an Underinsured Motorist Claim was opened with the insurance company that covered the truck that plaintiff was driving at the time of the collision.  After 26 months of delay on the part of the insurance company, the underinsured motorist claim was settled for $450,000.  Following that settlement, the Mastrangelo Law Offices filed at lawsuit for Insurance Bad Faith against the underinsured motorist carrier.

The lawsuit claimed that the insurance company intentionally delayed the resolution of the underinsured motorist claim for 26 months  and that the delay was unreasonable and violated the covenant of good faith an fair dealing that is implied in the insurance contract.  The lawsuit sought compensation for economic losses incurred by the plaintiff as well as punitive damages for the insurance company’s bad faith conduct.

The case was initially filed in state court but the insurace company removed the case to federal court.  The insurance company filed several motions with the court requesting that the case be thrown out.  The motions were denied.  The Mastrangelo Law Offices associated attorney Steven Anthony and depositions were completed.  The case was resolved at mediation and settled for $1,000,000.
